Art Course / Workshop / Painting Holiday Retreats Terms & Conditions

Please read this agreement thoroughly and carefully before booking; it contains important terms and conditions regarding the course / workshop or painting holiday retreat you are purchasing including, but not limited to, rights to postpone, cancel or alter, cancellation and refund policies, and a limitation of liability and other important disclaimers. This is a legally binding agreement.

1. Students participate at their own risk and are obliged to inform Nina of any existing significant medical conditions, allergies or special needs – any information provided will be treated as confidential.
2. No student will be permitted into a course / workshop / retreat if they have not fully completed a booking form. All class records and data will be maintained and processed in compliance with the GDPR and the Data Protection Acts.
3. Bookings are made for a specific course / workshop / painting holiday retreat, on specific dates, day & times. No student will be allowed to swap dates / days to make up for missed sessions for any reason. Should a student miss their course / workshop / painting holiday retreat for any reason no refunds will be given.
4. Cancellations & booking alterations for courses & workshops are refundable & transferable up to seven days prior to the course / workshop start date, after this no refunds or booking alterations will be made.
5. Cancellations for painting holiday retreats with more than 90 days in advance: 50% refund of the total payment (excluding the non-refundable deposit). Between 60 and 90 days in advance: 25% refund of the total payment (excluding the non-refundable deposit). Less than 60 days prior to the retreat: No refunds are given, unless your place can be filled. In this circumstance a 25% refund of the total payment (excluding the non-refundable booking deposit) will be made. Please note even with a waiting list, cancellation places are more difficult to fill nearer to the retreat start date.
6. No booking alterations can be made for Painting Holiday Retreats for any reason.
7. Nina is not responsible for expenses incurred by participants in preparing for a trip (eg. nonrefundable advance purchase of air tickets, equipment, etc.) or for any additional arrangements pre – or post – retreat commencement date. Therefore “cancel for any reason” travel insurance is strongly recommended to protect your investment should anything arise that may effect your ability to attend the Painting Holiday Retreat.
8. In the event of any medical care being administered to students during courses / workshops / retreats, Nina assumes no responsibility for any such medical care provided to you. You are solely responsible for any and all costs of medical care and related transportation, if any, that are provided to you during courses / workshops / retreats. Students on painting holiday retreats are advised to hold medical emergency & accident insurance to include medical emergency evacuation insurance.
9. Should an unforeseen circumstance arise, such as but not limited to, acts of nature, war, labour strikes, pandemics, earthquake, flooding, etc., where Nina needs to cancel a painting holiday retreat, refunds of fees LESS BOOKING DEPOSITS will be made.
10. Nina reserves the right to cancel, reschedule or make changes to the itinerary of a course / workshop / retreat, at any time due to insufficient registration numbers, illness, or whenever, Nina in her sole discretion,  judges conditions warrant, or if she deems it necessary for the comfort, convenience, or safety of students. In such instances, refunds of fees LESS BOOKING DEPOSITS will be made.
11. Painting holiday retreats require students to have a moderate level of fitness & mobility. Some painting sessions will be worked En Plein Air (outdoors) on location and require varying levels of demands on fitness. Students are responsible for & will need to carry their painting kit to their chosen painting spot. Connemara is a rural place where harbour piers, beach walks, boreens & pathways all have uneven ground. The accommodation has some stairs. By making a booking, students represent that they do not have any physical or other conditions that would create a hazard for them, other attendees or Nina, or affect other people’s enjoyment of the trip. Students have assumed the responsibility to select an activity appropriate to their physical abilities and interests. You are personally responsible for being in sufficiently good health to undertake the activity.
12. Other providers are solely responsible and liable for providing their respective services. Nina shall not be held responsible for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government, or by acts of nature, strikes, fire, flood, war, terrorism, sickness, theft, or any other cause(s) beyond their control. Students waive any claim against Nina for any such loss, damage, injury, or death.
13. Course, workshop & retreat details with times, fees and booking forms are published on Nina’s website (See ninapatterson.com).
14. All bookings must be made online. Bookings will only be deemed accepted & places secured, if accompanied by the payment of fees in full, and a fully completed booking form accepting these T&C’s.
15. PLACES ARE FILLED ON A FIRST COME FIRST SERVED BASIS. However, students who have been in class for the previous term are given first preference to renew their place. NO STUDENT IS AUTOMATICALLY RE – ENROLLED FOR THE NEXT TERM.
16. Payments are processed online securely by Stripe. All major credit cards are accepted.
17. Nina reserves the right to make changes to course / workshop / painting holiday retreat timetables.
18. Nina reserves the right to exclude / refuse entry to students from courses / workshops / painting holiday retreats, for reasons of unsuitability or other at her own discretion.
19. Students are required to provide an additional emergency contact name & number.
20. Students are obliged to take care of their own belongings and artwork. Nina accepts no liability / responsibility for lost, stolen or damaged belongings.
21. On painting holiday retreats students are provided with their own painting kit  – which they are responsible for keeping & cleaning.
22. Nina accepts no responsibility / liability for any damage to clothing.
23. Nina has comprehensive insurance in place. However, liability is restricted to event time only and then only in the case of gross negligence.
24. Photographs and videos of students and their artwork may be taken for promotional reasons. Nina uses photographs sensibly and aims to never publish names with photographs.
25. When bookings are made your details are stored and added to Nina’s marketing database. If you wish to be removed from the database simply unsubscribe anytime or email, text or call with the word “remove” and Nina will remove all your details from the database.
26. Nina reserves the right to make changes to the terms and conditions as the situation arises.
27. It is students responsibility to read, understand & be familiar with these terms and conditions.
